Dawgs N Hawgs probation extended

Dan Eakin/Staff Photo - About a dozen smiling bikers drove away from in front of McKinney City Hall on Tuesday night after the city council voted unanimously to extend Dawgs N Hawgs' probation for another six months to allow the private club to come into compliance with the city's ordinance requiring that at least 35 percent of gross receipts comes from food sales.

Dawgs N Hawgs, a private club in the 300 block of Louisiana Street in downtown McKinney, will remain open, at least for another six months.

At a city council meeting last month, city staff had recommended the club be shut down for non-compliance with an ordinance rule that "not less than 35 percent of the gross receipts be derived from the sale of food consumed on the premises."

The club had been placed on six months probation last October for non-compliance.

At the April 17 meeting, George (Pat) Thurman, club co-owner, said the club had made progress toward meeting the requirement but admitted it was still short.

Several people spoke in support of giving the club another six months probation, and the council voted to delay action until Tuesday's meeting.

Much to the delight of several Dawgs N Hawgs supporters in the audience, the council voted unanimously to grant another six months probationary period to give the club more time to come into compliance.

"Compliance with the gross receipts requirement will be established if Dawgs N Hawgs achieves the required percentage of food sales for not less than three of the six months probation," said Jennifer Cox, city planning director. "The council also asked that an update on the Dawgs N Hawgs progress be provided in three months time."

Before voting to extend the probation, the council had to vote to modify a section of the ordinance to allow "one or more" probation periods to be extended to a club in non-compliance.

Gene Childress came before the council to thank them for approving the extension. Twelve other people submitted cards to the council stating that they did not wish to speak but would like to express their support for keeping Dawgs N Hawgs open.

Mayor Brian Loughmiller urged the club supporters to "buy a lot of hot dogs there" to help bring food sales up to the required percentage.
